The government signed the new tax regulation on IT-based collection of tax information

Companies who submit Corporate Income Tax (CIT) and Personal Income Tax (PIT) will be obliged to submit returns on income (revenue) of natural persons and taxpayers of corporate income tax via electronic communication means. That emerges from an amendment of personal income tax law and other regulations that where accepted by the government. As the government has notified the main objective of this project is the IT-based collection of tax information by tax authorities. This is necessary to launch the service of pre-filled returns (PFR) for income taxpayers. According to the bill the number of documents that are submitted in paper form will be limited.

Incorporating into the Act on Personal Income Tax (PIT) an obligation for the taxpayers and business entities, which do not have the function of the payer of this tax to the authorities, the information about the income (revenue) of the taxpayer exclusively by electronic communication means. However, exempt from these requirements are those who provide information on tax which pertains towards not more than five taxpayers. They may submit these documents in paper form. This is to be read in a notification of the information centre of the government.

This means that the taxpayer needs an account to participate in ‘e-tax’. This account will be set up by the Ministry of Finance. There she/he finds a pre-filled return and when the taxpayer states that everything is in order, she/he has a function ‘submit’ and receives automatically an acknowledgement of receipt.

It was highlighted that the proposed solution will facilitate tax settlements, restrain most common errors during tax settlements and reduce documents in paper form. The taxpayer has the advantage that the authority will prepare a pre-filled return and the taxpayers are not obliged to submit further information during tax settlement. Taxpayers will submit summary information on many taxpayers, signed with an electronic signature.
